Ephedrine in Georgia: Is it BANNED or Legal to Buy Online?

Ephedrine alkaloids have been used in allergy medications, asthma treatments, cough and cold remedies as well as in other products designed to improve breathing conditions.

Ephedrine was also formerly sold as a popular ingredient in diet pills, fat burning supplements and pre-workout energy boosters. However, the FDA has now banned its inclusion in dietary supplements.

Under Georgia state law, it is legal to buy ephedrine HCL tablets without a prescription, but the sale and possession of this product is restricted. There are also US federal laws that apply to all such purchases and that prevent individuals from buying too much at a time.

There are also laws that regulate the over-the-counter sale of pseudoephedrine (Sudafed) at drugstores, but these laws are slightly different. Not all states have the same laws regarding sale of ephedrine or pseudoephedrine, both of which are precursors in the manufacture of methamphetamine.

Sales of these products by pharmacies, retail distributors and grocery stores have come under increased scrutiny to ensure these ingredients are not being diverted to the illegal drug black market.

In Georgia, consumers will find that medical prescriptions are not required to purchase ephedrine or pseudoephedrine, although some stipulations do apply to its sales.

Ephedrine is found in small amounts in a number of asthma bronchodilator medications, cold and flu products, and in cough medicine formulas. These products can only be sold at grocery stores, general merchandise stores, drugstore or convenience stores.

There is a single-day sales limit for the maximum amount an individual can purchase in a day of 3.6 grams, irrespective of the number of transactions. There is also a maximum sale limit for any 30-day period of 9 grams.

Under US federal law, purchasers will have to show ID, be at least 18 years of age and have their transaction and personal information recorded in a logbook when buying ephedrine products.

There are limits to possession of this product including more than 9 grams of ephedrine, pseudoephedrine or phenylpropanolamine, their salts, isomers, or salts of isomers, or a combination of any of these substances.

Individuals can possess a maximum of 300 pills, tablets, gelcaps, or capsules of these products combined for personal use. It is unlawful for a person to possess any of the above-mentioned substances with intentions to use it in the manufacture of methamphetamine.

Knowingly possessing more than the maximum amount with the intention of using it to manufacture illegal drugs is a felony punishable by imprisonment for one to ten years.

Laws on the possession and sale of this product in Georgia can be found under Title 16 (Crimes and Offenses), Chapter 13 (Controlled Substances), Article 2 (Regulation of Controlled Substances) of the 2010 Georgia Code. [1]

Section 16-13-30.3 defines the possession of substances containing ephedrine, pseudoephedrine, and phenylpropanolamine and restrictions on sales of products containing pseudoephedrine.

Under the Georgia Criminal Code and State Regulations, psueodoephedrine is an Exempt Over-the-Counter Schedule V controlled substance but ephedrine is not. The regulations that apply to the sale of this product are different than restrictions that apply to any product that contains only ephedrine or phenylpropanolamine.

Purchasing Ephedrine in Stores

A number of products do contain ephedrine and pseudoephedrine that are used for medicinal purposes. In order to buy these products, you must provide a government-issued valid photo ID.

Retailers and pharmacists are required to keep a log book regarding sales and receipts of such products. Information recorded in such log books will include the name of the product, milligram strength, quantity sold, as well as the name and contact and other identification information on the purchaser.

Retail distributors selling ephedrine in Georgia as well as pseudoephedrine or phenylpropanolamine are required to undergo training under the “Georgia Meth Watch” program. They are required to report all suspicious sales of these products to law enforcement agencies.

An individual who knowingly obtains more than the allowed amounts (first violation) may be charged with a misdemeanor violation and fined up to $500. Subsequent offenses may be punished with prison time and fines up to $1,000, or both.

There is a difference between the legal status of ephedrine and ephedra. Ephedrine is a plant chemical that has been isolated from the ephedra herb.

This herb is legal to buy, purchase, possess and use when sold as an herbal remedy or a raw plant product. However, in 2004 the FDA ruled that any dietary supplements containing ephedrine alkaloids were illegal.

While you can buy ephedra extract in bulk powder or liquid tincture form, it cannot be used as an ingredient in weight loss supplements or energy pills.

The FDA’s ruling did leave room for an exception to the law. Specifically, the regulation only applies to the sale of ephedra supplements that contain any quantity of ephedrine. Since not all of the species of the ephedra plant contain ephedrine alkaloids, not all forms of this plant have been banned.

There are still a number of ephedra extract supplements that are legal to buy in the USA. They remain legal because they are devoid of the banned ephedrine alkaloids. While you will not see these products sold on Amazon, eBay, GNC or other major retailers, you can find them from some specialty health and nutrition stores that operate exclusively over the internet.
